What is an Occupation Contract?
To start your tenancy on a sound legal footing, you’ll need an up-to-date contract signed by all parties: landlord, contract-holders and guarantors. Under Welsh law, most private tenancies need to use rental agreements called standard occupation contracts. A written statement of these contracts must be provided to tenants.
Occupation contracts were introduced when the Renting Homes (Wales) Act 2016 came into force in December 2022. Some details and clauses are mandatory, but this does not include all terms that a landlord may need.
It is therefore highly recommended for a landlord to use a professionally-drafted occupation contract (such as OpenRent's), in order to ensure that they don't miss out mandatory terms and risk significant fines for non-compliance, but do include all the terms that a landlord may need in order to protect their property.
